Marriage License

The Town Clerk is responsible for issuing a New York State Marriage License to qualified applicants as well as recording the marriage with the New York State Department of Health. The marriage record is on file in the clerk’s office and in Albany.

Licenses to marry in New York State may be obtained from the Town Clerk's office regardless of the residence of either of the parties. Once the license is issued you must endure a 24-hour waiting period. After those 24 hours has passed the ceremony must be performed within 60 days, and can be performed anywhere in New York State.

In order to obtain a marriage license, the applicants must:

  • Both applicants must appear in person
  • Present valid photo ID (driver's license or passport)
  • Social security card
  • Their birth certificate with a seal listing parents name
  • Marriage license applicants whose previous marriage(s) ended in divorce, annulment or death of spouse, must provide proof of dissolution of all previous marriage(s) by presenting a certified copy of divorce or annulment decrees and/or a certified copy of a death certificate for each previous marriage.

The cost of a New York State Marriage License is $35.00 and Certified Transcripts of Marriage are available for $10.00 per copy. (Cash or Check payable to: Nunda Town Clerk)

Licenses are issued by the Nunda Town Clerk during regular office hours.

Marriage Records

All marriage licenses that are acquired in the Town Clerk’s office are filed with the Town and New York State Department of Health and a marriage certificate is issued by the Town Clerk.

A certified copy of a marriage transcript is only available to an applicant eligible to receive it.

A certified copy or a certified transcript of a marriage certificate may be issued only:

  • To the persons named as one of the spouses in the marriage certificate
  • To the parents of the person named on the marriage certificate
  • To the lawful representative of the person named or the parents of the person named on the marriage certificate
  • To a person with a NY State Court Order
  • To a municipal, state or federal agency when needed for official purposes

If you meet one of the listed requirements from above, you must bring one of the following proofs of identification with you to the Town Clerk’s Office, along with your completed marriage copy application:

  • A valid driver's license
  • State issued non-driver's license identification card
  • Military identification card
  • Valid passport
  • Employer's photo identification card
  • Police report documenting the applicant's name, address and theft or loss of positive identification

The cost for a certified copy is $10.00 (Cash or Check payable to: Nunda Town Clerk)
