Zoning Board of Appeals

The Zoning Board of Appeals is a five member board divided between Town and Village appointed seats.

The Zoning board became joint board in 1993 as listed in our local law index, 1-1993, Creation of Joint Zoning Board of Appeals for Village & Town and further amended in 2011 in local law1-2011, Amending Local Law No. 1 & 2 of 1993.

The Board acts on matters of requesting variances for uses of land or buildings which may not be allowed in the Zoning Code and Regulations of Nunda.

They act much as a judicial board and meet as needed at the Nunda Government Center, after public notice is published. Legal notices are published in the Livingston County News at least 3-7 days prior to the scheduled meeting date and posted at the Nunda Post Office and Nunda Government Center.

The Joint Zoning Board of Appeals annually elect a chairman from its members.

The Nunda Village and Town Board annually appoint the secretary who shall not be a member of the board but compensated at a rate set by said Boards.

Four (4) Hours of training is required annually of all Zoning Board Members.

The Town Board of the Town of Nunda shall have the power to remove members appointed by the Town of Nunda, subject to the provisions of 271 of the Town Law of the State of New York.
